Terms of sale and website use
1. Seller and scope
These terms govern consumer purchases of LÉVOJU skincare from this Evolved Health store and use of the website. The legal seller and contact details are identified in our Legal notice. LÉVOJU is a brand, not a separate contracting party. Shopify provides the commerce platform; production and fulfilment partners assist with delivery. Your purchase contract is with the seller, who remains responsible for its obligations.
Mandatory consumer rights always apply, including the protections of your country of habitual residence where applicable. These terms do not exclude statutory rights by describing products as “as is”, by requiring claims against a manufacturer first, or by treating browsing as consent to optional data processing.
2. Ordering and contract formation
You may review and correct your basket, contact information, delivery address and payment details before submitting an order using the payment-obligation button at checkout. Submitting an order is your offer to buy. An automated acknowledgement alone confirms receipt; acceptance occurs when we expressly confirm acceptance, dispatch the goods or capture payment, whichever occurs first. A payment authorisation alone is not capture. If we cannot accept an order, we notify you and promptly release or refund any payment taken. We cannot unilaterally change the goods or agreed price after acceptance.
Contracts can be concluded in English or German. Save your order confirmation and these terms for your records; we provide the legally required contract information by email or another durable medium. Please provide accurate information and use a payment method you are authorised to use. If you lack legal capacity to contract, the required guardian authorisation must be obtained.
3. Products, prices and payment
The product description and price shown at the time of your order form part of the contract. Screen settings may cause minor colour differences, but do not excuse a materially different or misdescribed product. Future changes to products or prices do not alter an accepted order. We may restrict future availability or reasonable order quantities, subject to law.
The checkout shows the order currency, applicable delivery costs, taxes and total payable before submission. EU/UK consumer prices include applicable taxes that must be included by law. US sales tax, where applicable, is shown before purchase. Any import charges not collected by us must be disclosed before purchase. Only payment methods offered in checkout are available. Unless expressly agreed otherwise, payment is due on ordering. Goods remain our property until paid in full to the extent permitted by applicable law; this does not transfer delivery risk to you early.
Discount eligibility and combination rules are shown with the offer. Discounts do not remove legal consumer rights. Correcting an error is not a right to charge a higher price without your agreement.
4. Delivery, withdrawal and faulty goods
Our Shipping policy explains destinations, delivery and delays. See our Returns and withdrawal policy for return information. Mandatory withdrawal and defective-goods rights take priority over any conflicting return condition. We remain responsible for statutory conformity, delivery and refund obligations even when another business manufactures or ships your order.
5. Product use and information
Follow the product label, ingredient list, warnings and storage instructions. Cosmetic information, SkinSpace suggestions and educational content are general information, not individual medical advice or a diagnosis. Results and tolerance vary; natural or botanical origin does not guarantee suitability for every person. Stop use if irritation occurs and seek professional advice as appropriate. These statements do not limit liability for an unsafe or defective product, misdescription, or a claim we are legally responsible for.
6. Subscriptions, where expressly selected
A one-time purchase does not create a subscription. If you choose a subscription, its recurring price, billing frequency, delivery frequency, any minimum commitment and cancellation terms must be disclosed before you agree. Recurring charges require your express agreement. You may contact support@evolvedhealth.de to give a cancellation notice; available account controls provide an additional route. Statutory withdrawal, termination and renewal protections remain intact. We do not apply undisclosed fees or retrospective changes to an existing subscription.
7. Website, accounts and intellectual property
Keep account credentials secure and notify us of suspected misuse. You may not use the website for fraud, unlawful content, security interference or infringement of another person’s rights. We may proportionately restrict abusive or unlawful access, without extinguishing your existing order, refund or statutory rights.
Website text, photographs, graphics and brand assets are protected where intellectual-property rights exist. You may browse and use them for personal shopping and make copies permitted by law. Commercial reuse requires the relevant rights holder’s permission. Submitting a review does not transfer ownership of your content; you permit us to display and format it for the purpose for which you submitted it, subject to applicable rights. We do not claim permission to use private support messages as advertising merely because you send them.
Links to third-party websites are provided for convenience. Their own terms and privacy practices apply to their services. This does not exclude any responsibility that applicable law places on us.
8. Liability
We are liable without limitation for intent and gross negligence; culpable injury to life, body or health; fraud; liabilities under mandatory product-liability law; and obligations under any guarantee we expressly give, within its scope. For ordinary negligence, where German law permits, liability for breach of an essential contractual obligation is limited to the foreseeable damage typical of the contract. An essential obligation is one whose performance enables the contract to be properly performed and on which you may ordinarily rely. Liability for ordinary negligence in other cases is excluded only to the extent legally permitted. These restrictions do not reduce mandatory consumer remedies or liabilities that your applicable local law prohibits us from limiting. No blanket indemnity, compulsory arbitration or class-action waiver is imposed on consumers by these terms.
9. Privacy and complaints
Our Privacy policy explains personal-data processing and your choices. Contact support@evolvedhealth.de for complaints, order assistance or legal enquiries. Contacting us first is not a condition of using any statutory complaint or court remedy.
Shopify Network Intelligence is enabled. Our store is hosted by Shopify, which receives information about visits and purchases. For its enhanced services, Shopify combines information from interactions with this store, other merchants and Shopify to support service improvement, personalisation and advertising. Shopify acts as an independent controller for this processing. Shopify and relevant service providers may process this information in other countries. Consent is required for personalised advertising involving EEA, UK and Swiss visitors. Use our cookie preferences to withdraw consent; use Your Privacy Choices to opt out of advertising sharing where applicable. You can also exercise rights concerning Shopify’s own processing through its privacy portal.
10. Governing law and changes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice does not deprive consumers of mandatory protections that would apply without that choice, including applicable protections of their habitual residence. Statutory jurisdiction rules apply; consumers are not forced to litigate exclusively in Germany.
The version in force when the contract is concluded applies to that purchase. Later website updates do not retrospectively change it. Individually agreed terms and mandatory law take priority. If a provision is invalid, applicable law governs in its place; the rest remains effective where legally possible. No rule in these terms requires ambiguity to be resolved against a consumer.
